Nach einem mehrjährigen und intensiven Gesetzgebungsprozess auf EU-Ebene tritt heute der Digital Market Act in Kraft, der den großen Tech-Unternehmen Verpflichtungen auferlegt, um den Missbrauch ihrer Marktmacht zu verhindern. Wettbewerbsexperte Tomaso Duso, Leiter der Abteilung Unternehmen und Märkte im DIW Berlin, kommentiert das Gesetz wie folgt:

Mit dem Digital Market Act (DMA) tritt endlich eine Regelung in Kraft, die die Marktstellung der großen Digitalkonzerne aufgreift und faire Wettbewerbsbedingungen im digitalen Binnenmarkt zu gewährleisten verspricht. Sechs Tech-Giganten wurden zunächst als Gatekeeper definiert: Alphabet, Amazon, Apple, ByteDance, Meta und Microsoft, aber auch andere Unternehmen wie Booking.com stehen auf der Beobachtungsliste. Diese Unternehmen bieten Dienste an, die für jeden Anbieter, der in der digitalen Welt Geschäfte machen will, unverzichtbar sind. Aufgrund ihrer zentralen Stellung und ihrer großen Marktmacht müssen sie künftig besondere Pflichten erfüllen und sich an Verhaltens- und Datenzugangsregeln halten. Anders als im Wettbewerbsrecht, wo die Beweislast bei den Behörden liegt, die nachweisen müssen, ob Unternehmen gegen die Wettbewerbsregeln verstoßen haben, wurden im DMA spezifische Pflichten im Voraus definiert. Deren Einhaltung müssen die großen Tech-Unternehmen nun durch Compliance Reports nachweisen.  

In den vergangenen Jahren waren die Instrumente der Wettbewerbspolitik überfordert und zu langsam, um der enormen Dynamik und der Komplexität dieser Märkte gerecht zu werden. Mit der neuen Regulierung hat Europa Maßstäbe gesetzt, um den Wettbewerb auf den immer zentraler werdenden digitalen Plattformmärkten durch klarere und effektivere Regeln zu schützen. Jetzt ist die Zeit der Durchsetzung gekommen: Insbesondere die Europäische Kommission, aber auch die nationalen Wettbewerbsbehörden wie das Bundeskartellamt in Deutschland sind gefordert, eine neue und sehr komplexe Aufgabe zu übernehmen, für die es viel Mut und Entschlossenheit braucht. Es geht um die Sicherung von Wettbewerb, Innovation und Wohlstand, aber auch um ein Stück Demokratie.

(B2) Le MV True Confidence, un vraquier libérien battant pavillon de la Barbade, a été touché mercredi (6 mars), vers 11 h 40 (locales), par un missile balistique antinavire (ASBM) alors qu'il transitait par le golfe d'Aden à environ 54 nautiques au sud-ouest d'Aden.

Trois morts, trois blessés graves

Les dégâts sont importants en termes humains : « trois morts, au moins quatre blessés, dont trois dans un état critique » selon le CentComUS. L'équipage a dû abandonner le navire via des canots de sauvetage. Ils ont été recueillis à bord du navire de guerre indien Kolkata. Plusieurs navires de guerre de la coalition s'étant portés au secours du navire, notamment pour aider l'équipage. NB : Peu de temps auparavant, vers 3h locales, le navire avait reçu un appel radio par VHF venant d'une entité se prétendant de la marine yéménite, selon le centre britannique de surveillance maritime (UKMTO).

Dégâts importants, incendie à bord

Les dégâts sont aussi « importants » pour le navire. En soirée du même jour (6 mars), le vraquier a été « signalé à la dérive avec un incendie persistant à bord » signale une source militaire. L'objectif est de le remorquer. Si les informations se confirment, ce serait le deuxième navire détruit ou mis hors d'usage par les Houthis. Ce qui démontre une certaine escalade dans la tension entre Houthis et forces de guerre sur place.

Le 100e incident

C'est le 100e incident de ce type recensé par les forces internationales depuis le début des attaques des Houthis, notamment la spectaculaire prise d'un navire marchand en mer Rouge en novembre (lire : [Actualité] Les Houthis détournent en mer Rouge un navire « israélien ». Plusieurs marins européens capturés).

Une autre attaque dans le golfe d'Aden

C'est le cinquième tir de missile balistique anti-navire tiré par les Houthis dans les deux derniers jours selon le CentCom. Un autre navire marchand, le MSC Sky II, un porte-conteneurs appartenant à la compagnie italo-suisse MSC et battant pavillon libérien, a été atteint lundi (4 mars) par un missile à 85 nautiques au Sud-Est d'Aden, qui a provoqué un incendie (vite maitrisé). Attaque revendiquée par les Houthis. Un dernier missile a été abattu par le navire américain USS Carney (DDG 64).

Une course-poursuite dans le golfe d'Oman

Plus à l'Est, à 21°02 Nord et 061°54 Est, mardi (5 mars), un navire marchand a signalé avoir été approché « de manière suspecte » par une embarcation rapide. Malgré le fait d'avoir augmenté sa vitesse, la poursuite a continué, « durant près d'une heure » selon des sources maritimes. Poursuite qui « n'a cessé qu'à la tombée de la nuit ».

Mis à jour sur les dégâts au navire True Providence et l'attaque dans le golfe d'Oman

The European Defence Agency (EDA) has brought together two EU Member States to develop a satellite demonstrator that can manoeuvre from Low Earth Orbit  (LEO) to Very Low Earth Orbit (VLEO)  – and back again. 

The €10 million project – called LEO2VLEO: Military Crisis-Response Satellite Constellation – with the Netherlands and Austria, will design, develop, launch and operate a constellation of between two and four satellites. It aims for a space launch in two years time. In this innovative approach to space, the project will, once operational, have the capability to support military operations. 

The project was signed on 19 January 2024 between the Netherlands, Austria, and EDA. It was signed in EDA’s Capability Technology Area (CapTech) Space, which helped bring the two countries together for this collaborative project. EDA will support the project throughout.

Very Low Earth Orbit (VLEO) is most commonly situated at an altitude of between 250-350 kilometres. It has the advantage of being closer to the earth than the traditional orbit of satellites, allowing for higher resolution images from optical sensors, improved communications and agility.

As a demonstrator for initial space capabilities, the LEO2VLEO project aims to show the cost benefits of such an approach in a short timeframe. While VLEO is safer from collisions with space debris because objects eventually burn up, dragged into the Earth’s atmosphere, such altitudes require satellites to deal with surface erosion from atomic oxygen and so need more resistant materials. 

Developing a satellite able to manoeuvre back into the traditional Low Earth Orbit (LEO) would extend its lifespan by spending time in VLEO only when necessary, as well as presenting lower costs and additional launch opportunities.

EDA Hub for EU Defence Innovation, known as HEDI, has funded a preliminary study for this problem; HEDI was established within EDA in 2022 to foster innovative solutions for military capabilities. If successful, the LEO2VLEO demonstrator could pave the way for a fully operational system to support military missions in the future.

EDA's wider role  

EDA supports its 27 Member States in improving their defence capabilities through European cooperation. Acting as an enabler and facilitator for Ministries of Defence willing to engage in collaborative capability projects, the Agency has become the hub for European defence cooperation with expertise and networks allowing it to the whole spectrum of defence capabilities.  

Member States use EDA as an intergovernmental expert platform where their collaborative projects are supported, facilitated, and implemented. For more details, please see here.
