The British High Court declared on Thursday that May’s government has not legal authority to start the Brexit process without prior parliamentary approval.

The Parliament is the only body empowered to use royal prérogatives in order to trigger Article 50 of the Treaty on European Union, i.e. the mechanism for the voluntary and unilateral withdrawal of a country from the European Union.

Yesterday, three senior judges started a hearing process that could legally challenge Brexit outcomes.

David Pannick, a distinguished British barrister, pleaded before the court that “prerogative powers may not be used by the minister to remove rights established by the act of parliament.”

Therefore, only the parliament can change the European Communities Act away through the enactment of a new legislation.

The hearing will continue until next week and any possible High Court’s decision will be appealed and sent to the Supreme Court, which will begin a hearing in December.

Est paru au JO n°0240 de ce 14 octobre 2016 le texte du décret n° 2016-1364 du 13 octobre 2016 relatif à la garde nationale.

Il précise la composition des organismes de direction, des organismes au nombre de quatre:

- Le comité directeur de la garde nationale:
"Ce comité, présidé par le secrétaire général de la garde nationale, réunit : 1° Pour le ministère de la défense : - les délégués aux réserves des forces armées et formations rattachées relevant du ministre de la défense ; - le directeur des ressources humaines du ministère de la défense ou son représentant ; - le directeur de la délégation à l'information et à la communication de la défense ou son représentant ; 2° Pour le ministère de l'intérieur : - le délégué aux réserves de la gendarmerie nationale ; - le directeur des personnels militaires de la gendarmerie nationale ou son représentant ; - le directeur des ressources et des compétences de la police nationale ou son représentant ; - le délégué à l'information et à la communication ou son représentant."

- Le comité de pilotage de la garde nationale:
"Ce comité, présidé par le secrétaire général de la garde nationale, réunit : 1° Pour le ministère de la défense : - les délégués aux réserves des forces armées et formations rattachées relevant du ministre de la défense ; - le directeur des ressources humaines du ministère de la défense ou son représentant ; - le directeur de la délégation à l'information et à la communication de la défense ou son représentant ; 2° Pour le ministère de l'intérieur : - le délégué aux réserves de la gendarmerie nationale ; - le directeur des personnels militaires de la gendarmerie nationale ou son représentant ; - le directeur des ressources et des compétences de la police nationale ou son représentant ; - le délégué à l'information et à la communication ou son représentant.

- Le conseil consultatif de la garde nationale:
"Outre les membres du comité de pilotage, il comprend : 1° Un député, désigné pour la durée de la législature par le président de l'Assemblée nationale, et un sénateur, désigné après chaque renouvellement partiel du Sénat par le président du Sénat ; 2° Quatre personnalités qualifiées, nommées par arrêté conjoint du ministre de la défense et du ministre de l'intérieur pour une durée de quatre ans renouvelable. Il peut entendre toute personne dont la compétence est requise par l'ordre du jour. Il se réunit au moins une fois par an, à l'initiative du secrétaire général de la garde nationale. En cas de décès ou de démission de l'un des membres visés aux 1° et 2°, ou lorsque l'un d'eux cesse de remplir les conditions pour exercer les fonctions au titre desquelles il a été nommé, il est pourvu à son remplacement dans les mêmes conditions pour la durée du mandat restant à courir.

- Le secrétariat général de la garde nationale:
"Le secrétariat général de la garde nationale est dirigé par un secrétaire général, placé sous l'autorité conjointe des ministres de la défense et de l'intérieur. Le secrétaire général de la garde nationale est nommé pour deux ans par décret en conseil des ministres sur proposition conjointe des ministres de la défense et de l'intérieur. Il préside le comité de pilotage de la garde nationale et le conseil consultatif. Il prépare leurs avis et recommandations et en suit la mise en œuvre. Il peut être chargé par le ministre de la défense et le ministre de l'intérieur de toute question relative à la garde nationale, à l'exclusion de l'emploi et de la préparation opérationnels."

Outre le secrétariat général, ce sont au moins 26 personnes qui sont citées. Voilà de quoi contribuer aux effectifs de la garde.

Commentaire matinal de François Cornut-Gentille dans un post sur le "monstre" : "Chacun l’aura compris, la garde nationale est avant tout une question de bureaucratie".

 

Le premier débat de la primaire à droite a atteint un pic d'audience à 21h30 avec 6,5 millions de téléspectateurs. C'était le programme le plus regardé de la soirée de jeudi.

There was a touch of nervous twitching (Nicolas Sarkozy), a few polite sideswipes at the frontrunner (Alain Juppé), some jibes over integrity (deflected by Sarkozy and Juppé), a fair amount of policy consensus (almost unanimity on ditching the wealth tax and flouting EU deficit limits), and certainly a surplus dry preparation (technical talk came easy to most). But there was probably no breakthrough winner.

The seven hopefuls vying for France’s centre-right presidential nomination met for their first TV debate on Thursday night. Perhaps because nobody can doubt the importance of the contest – from it is likely to emerge France’s next president – the discipline held, as did probably the political order of things. Former prime minister Mr Juppé remains the man to beat and Mr Sarkozy can barely contain his irritation. There were mini-flashes of passion and raw politics. But the two-hour showdown became at times an arid, earnest affair. Probably a small mercy given what we endure in the White House race.

The Hellenic Foundation for European and Foreign Policy (ELIAMEP) is interested in hosting researchers intending to submit an application for the call of Individual Fellowships in the framework of the Irish Research Council MSCA CAROLINE 2017 fellowships. All fellowships under CAROLINE will be hosted by an Irish research-performing organisation (RPO), with international and inter-sectoral mobility.

The application process is to be driven by prospective applicants, which includes identification of suitable host organisations and mentors (academic as well as in the NGO/IO sector). Applicants would then liaise with their prospective academic mentor (in host organisation) as well as with their proposed secondment mentor (in partner organisation)  as they are preparing their fellowship application.

From the point of view of deadlines applicable to organisations participating in a proposal, the application process will involve completing a brief online form in advance of the applicant deadline (which is 4pm Ireland time on 30th November 2016) on behalf of the organisation. The proposed secondment mentor will then be required to complete an online statement in support of the application; deadline for submitting this statement is 4pm Ireland time on 7th December 2016.

The Council offers two types of CAROLINE fellowships.

α) Irish fellowships- Researchers awarded an Irish fellowship will be hosted by a home host institution in Ireland for two years, with a mandatory secondment of between six and twelve months’ duration during this time to a main partner organisation with an optional placement to a placement partner organisation possible (up to three months). Eligible applicants are those of any nationality or residency who have not been in Ireland for more than twelve months in the three years prior to the time of recruitment.

β) International fellowships- Researchers awarded an International fellowship will spend the first two years seconded to their main partner organisation outside Ireland, with a mandatory one-year return phase at their home host organisation in Ireland, with the potential for optional placements to placement partner organisation(s). Placements can be up to six months in the outgoing phase and another six months in the return phase.

Eligible applicants are those who have not been in the country of the main partner organisation outside Ireland for more than twelve months in the three years prior to the time of recruitment.

All CAROLINE applicants must fulfil the criteria for one of the two experienced researcher types mentioned in the document 2017 CAROLINE Terms and Conditions. For example as regards “Experienced researcher type 1”, the researcher should have been awarded the doctoral degree within the seven-yearperiod before the time of recruitment.

CAROLINE fellows must not be a permanent member of staff in a HEI/RPO in Ireland or elsewhere. CAROLINE fellows must not be a permanent member of staff in the proposed main partner organisation. Eligibility criteria and mobility requirements for candidate fellows are available in the document 2017 CAROLINE Terms and Conditions.

ELIAMEP’s application to act as a partner organisation has been approved by the  Irish Research Council. ELIAMEP invites all applicants interested to submit an application for a Fellowship to the Council with ELIAMEP as a partner, to send a short CV and a summary presentation of their research proposal, prior to submitting their application online, to the email address: development@eliamep.gr .

Applications will be submitted via the Council’s online application system due to open for CAROLINE applications in mid-October. All applicants must create and complete their submission through the online system by the deadline of 16:00 (Irish time) on 30 November 2016.
